Article 01
The products presented on this site as well as their logos are the sole property of the marks them selves, and remain their property. As for the rest of the content of the site is the property of PASTORE-NICOLET SA, and can not be copied in its full form or partially without consent of PASTORE–NICOLET SA.
Article 02
All personal information obtained from a buyer will not be transmitted, sold or exchanged to any other company other than PASTORE-NICOLET SA
Article 03
All photos on PASTORE-NICOLET SA site are not contractual and are not presented at a real scale.
Article 04
Our responsibility as sales agent is in no way valid when an order form is received, all order forms partially or no filled in will cancel the said contract. Our obligation as sales agent will take effect only once the buyer has confirmed their order.
The sales agent reserved the right to refuse, without exception any order.
There for the sales agent reserves the right to change the price without any prior warning as well as other sales condition.
Finally, the buyer certifies they are above the age of 18 and have the authority to order the merchandize. Have verified that their order in no way infringes on the laws of there country of residence and or the country of final destination as well as guarantees that all information supplied to PASTORE-NICOLET SA is correct.
The sales agent excludes all responsibility in the case of non-conformity.
Article 05
The goods will be shipped out within 5 working days after reception of the payment for the order. The order will be shipped via the post or a repaid parcel company with transport insurance attached to the address supplied by the customer.
Transport Insurance
The transport insurance covers the risks of the package being lost or stolen during the transport of the mentioned package from our shop to the final destination’s post office.
In the case of a loss or theft we will conduct a postal search which can last a maximum of 2 months as of the date of the initial claim. Once we are in possession of the official paper work from the post relating to the loss of theft the package, we will replace the articles (under reserve of stock disposability). The cost of shipping will be under our responsibility.
Transport Costs
The confirmation of the order stipulates clearly the cost of transport (packaging, postal costs and insurance). However the import taxes, should it be customs or other administrative costs in the country of destination, are at the cost of the buyer solely. The buyer is therefore the sol responsible for taking care of the steps for the importation of the goods to the country in accordance with the present laws in place.
Articles 06
To benefit form a Tax Free purchase the customer will first have to prove that they are not a Swiss Resident and following that they will have to purchase over 400.- SFr worth of good in order to benefit form the Global Refund (internet site).
In the case that the merchandize is bought at our shop, we will supply the customer with the necessary forms to fill out in order to receive their refund when leaving the Swiss Territory.
If the order form has all the necessary information we will sell the merchandize Tax Free.
Article 07
All our merchandize is sold with a minimum of 2 years and maximum 5 years guarantee, as per the manufacturer. No other guarantee is supplied form the sales agent.
Article 08
Return Policy
The buyer can, within 15 working days time period as of the delivery date, return the merchandize.
If the buyer wishes to exchange there merchandize they will be billed the costs of transport as well as any customs costs.
If the buyer wishes a reimbursement the cost of transport as well as the equivalent of 20% of the catalogue value of the merchandize will be charged for restocking costs. If during the process of shipping the Sales agent wishes to modify the order the costs of transport and exchange will be at the sales agent’s charge. The trade will take place as soon as the returned merchandize is received by the sales agent and under reserve that the article delivered has no close in reference to the article on cancellations and returns.
If the merchandize ordered is in rupture of stoke, it will be completely reimbursed as well as the costs of transport.
Cancellation and rights of return
The merchandize must in no way have been worn or shortened. It must be returned in its original casing with the guarantee and other document accompanying the merchandize.
Should the merchandize not be received within 15 working days the claim will be refused.
Article 09
All problems arising from the interpretation, the competent tribunals of the Canton of Geneva will exclusively treat execution, non-execution or bad execution of the contract by all parties.
Article 10
For all questions regarding the present sales contract and its execution, the Swiss law is exclusively applicable.
The buyer certifies they have read and understood the above contract with all its conditions mentioned (Article 01 to 10 included), and accepts them unconditionally.
